Terms of Service

These Terms of Service ("Terms") govern Your access to and use of Monomi (the "Service", available at https://www.monomi.app), operated by Sausito LLC, 30 North Gould Street, Sheridan, Wyoming 82801, United States ("the Company", "We", "Us" or "Our"). Please read them carefully.

Acknowledgment

By accessing or using the Service You agree to these Terms. If You disagree with any part of them, do not use the Service. Your use of the Service is also subject to Our Privacy Policy and Disclaimer.

You must be at least 13 years old to use the Service. If You are under 18, You may use it only with permission from a parent or guardian, who agrees to these Terms on Your behalf.

The Service

Monomi gives You a prompt to use with Your own AI assistant (such as ChatGPT, Claude or Gemini, which are not affiliated with Us). Your AI answers in one word per question, and We turn those answers into a board and a short video You can view, save, download and share.

• Your use of Your AI assistant is governed by that provider's own terms. We do not access Your AI account and are not responsible for what Your AI answers.
• Results are generated by AI and are meant for fun and self-reflection. They are not facts about You, and they are not psychological, medical, financial or professional advice.
• Images in Your video are selected or generated by AI from Your answer words and may be imperfect or unexpected.
• We may add, change or remove drops, features and styles at any time.

Accounts

You can play without an account. Some features (such as saving or downloading Your Monomis) require one. You sign in with a one-time code sent to Your email or with Google; We do not use passwords.

You must provide accurate information, keep access to Your email secure, and tell Us right away about any unauthorized use of Your account. You are responsible for activity under Your account.

If You sign in with a Third-Party Social Media Service (such as Google), You authorize Us to use the information it shares as described in Our Privacy Policy. Your relationship with that service is governed by its own terms.

Purchases

We offer paid features: unlocking a whole board (all its answers, the full video and Your AI's reasons) as a one-time purchase, and Monomi+, a monthly or yearly subscription that unlocks every board. Prices, including any tax, are shown before You pay. Purchases are sold through Link, operated by Stripe, which acts as the merchant of record: it processes the payment, issues the receipt, appears on Your statement (as "LINK.COM* MONOMI.APP") and handles payment support. You represent that You have the legal right to use the payment method You provide.

• Digital content is delivered immediately. By purchasing, You agree that delivery begins right away and, where the law allows, You lose any withdrawal right once it does.
• Except where required by law, payments are non-refundable. We may review refund requests case by case at Our discretion.
• Subscriptions renew automatically at the end of each period until You cancel. You can cancel at any time at link.com or from Your receipt. You keep access until the end of the period You paid for. We will give reasonable notice before changing subscription prices.
• An unlocked board is tied to Your account: it stays unlocked whenever You open it while signed in.
• We may refuse or cancel an order if We suspect fraud or an unauthorized transaction, or if a price is wrong.

Your content

Your answers, the reasons Your AI gives, and any content You create with the Service (such as questions for Your own Monomi, if that feature is available) are "Your Content". You keep Your rights to it. You grant Us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify and display Your Content only as needed to operate and provide the Service.

Videos You download carry the Monomi label. You may post them on social media for personal, non-commercial use, keeping the label visible.

You represent that Your Content does not violate the rights of anyone else. You may not use the Service to create or share content that:

• is unlawful or promotes unlawful activity;
• harasses, bullies, defames or targets real people, or violates anyone's privacy;
• is hateful or discriminatory, sexually explicit, or encourages self-harm;
• infringes intellectual property rights, including copied question sets from commercial games;
• tries to manipulate other people's AI assistants (for example, prompt injection), or contains malware or spam;
• impersonates any person or entity, including the Company.

We may remove content and limit or suspend access to the Service if We believe these rules were broken.

Acceptable use

Do not misuse the Service: do not attempt to break, overload or reverse-engineer it, scrape it at scale, bypass limits or paywalls, or use it in a way that harms other users or the Company.

Intellectual property

The Service, its design, drops, questions, music, images and branding (excluding Your Content) are the exclusive property of the Company and its licensors, and are protected by copyright, trademark and other laws. Our trademarks may not be used without Our prior written consent.

If You believe content on the Service infringes Your copyright, email Our copyright agent at g@sausito.com with the information required by the DMCA (17 U.S.C. 512(c)(3)): Your signature, the work You claim is infringed, where the infringing material is, Your contact details, a good-faith statement, and a statement under penalty of perjury that the information is accurate and that You are authorized to act.

Feedback

If You send Us feedback or suggestions, You grant Us a perpetual, irrevocable, royalty-free, worldwide right to use them without restriction.

Links and third-party services

The Service links to and relies on third-party services (such as AI assistants and social networks) that We do not control. We are not responsible for their content, availability or practices.

Termination

We may suspend or terminate Your access at any time if You breach these Terms. You may stop using the Service and ask Us to delete Your account at any time by emailing g@sausito.com. If We terminate a paid subscription for convenience (not because of Your breach), We will refund the unused part of the period.

"As is" disclaimer

The Service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free or that AI-generated results will be accurate. Some jurisdictions do not allow these exclusions, so some may not apply to You.

Limitation of liability

To the maximum extent permitted by law, the Company will not be liable for any indirect, incidental, special or consequential damages arising from Your use of the Service. Our total liability is limited to the amount You paid through the Service in the 12 months before the claim, or 100 USD if You have not purchased anything.

Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, United States, excluding its conflict-of-law rules. If You have a concern, You agree to first try to resolve it informally by contacting Us. If You are a consumer in the European Union, You also benefit from the mandatory provisions of the law of Your country of residence.

You represent that You are not located in a country subject to a U.S. government embargo and are not on any U.S. government list of prohibited or restricted parties.

General

If any provision of these Terms is unenforceable, the rest remain in effect. Our failure to enforce a right is not a waiver of it. If these Terms are translated, the English version prevails.

Changes to these Terms

We may update these Terms. For material changes, We will make reasonable efforts to give at least 30 days' notice. Continuing to use the Service after changes take effect means You accept them.
